SUMMARY Under the general direction of the Presiding Judge, a commissioner performs various subordinate judicial officer functions including determining ex parte motions, conducting arraignments, hearing actions to establish paternity and child or spousal support, hearing small claims and infraction cases, and issuing bench warrants for failures to appear. The Superior Court Commissioner is appointed by majority vote of the judges. Court Commissioners serve at the pleasure of the judges and are prohibited from engaging in the private practice of law during their tenure. Employees in this at-will position are governed by the California Code of Judicial Ethics and court personnel policies. Court Commissioners must comply with the judicial education requirements.

Act as temporary judge in civil, criminal, and juvenile matters as directed and with the stipulations of the parties. Reviewing court files, documents, and related materials to assess cases prior to and following hearings; preparing Court Orders, records, reports, correspondence, and other written materials pertaining to case findings. Additional responsibilities include: family law temporary emergency requests, temporary restraining orders; fee waiver applications; traffic trials by declaration; emergency protective order (EPO) duty; and juror orientation. Serving on various committees as assigned. Performing other duties as assigned by the Presiding Judge.
Typical Qualifications
QUALIFICATIONS
Thorough knowledge of the California court system, state and local rules of court, legal principles, case precedents, rules of evidence, and trial procedures.
Ability to:
Objectively analyze and interpret legal issues and arguments, weigh evidence, draw inferences, and reach logical and legal conclusions
Exercise appropriate judicial temperament and demeanor
Direct and control courtroom proceedings in a decisive, orderly, and equitable manner
Communicate clearly and concisely, both verbally and in writing
Use relevant computer programs and software including, but not limited to legal research, the Court’s case management system, Microsoft Office Suite
Establish and maintain productive and effective relationships with judges, attorneys, and other Court and County staff.
EXPERIENCE AND EDUCATION Must be a current, active member in good standing of the State Bar of California and admitted to practice law in California for at least ten years. Family Law experience is preferred.
Education: Completion of a Juris Doctor degree or equivalent graduation from an accredited law school.
