The Director Compliance for Nestle Health Science U.S. will report to the General Counsel and will be responsible for leading the Compliance team and overseeing the development, implementation, and management of NHSc’s Corporate, Healthcare/Medical Nutrition and Pharmaceutical Compliance Programs, taking on a key collaborative leadership role throughout the organization.
PRIMARY RESPONSIBILITIES:
Healthcare / Medical Nutrition Compliance Program
Implement, monitor and continuously improve NHSc’s Healthcare Compliance Program:
- Advise the business on Sales and Marketing activities, customer and HCP contracts and interactions, pricing arrangements, Medical Affairs and Market Access projects, and other areas which may have healthcare compliance implications.
- Review new business initiatives to ensure that these arrangements comply with NHSc Healthcare Compliance Program and applicable regulations.
- Update NHSc’s Healthcare Compliance Program (including Policies, Standard Operating Procedures, and compliance guidance), as needed to address new compliance risk areas arising from new products, new business initiatives, or changes or updates to applicable legal and regulatory requirements.
- Develop and deliver NHSc’s healthcare compliance-related education and training programs.
- Conduct internal monitoring and auditing on an ongoing basis to assess compliance with NHSc’s Healthcare Compliance Program.
- Collaborate with members of the medical nutrition leadership team and senior management to effectively resolve compliance issues.
- Chair Healthcare Compliance Committee meetings.
- Prepare and deliver annual Healthcare Compliance Report to leadership.
Pharmaceutical Compliance Program
Implement, monitor and continuously improve NHSC’s Pharma Compliance Program:
- Provide strategic direction and leadership for compliance for the Pharmaceutical Business.
- Understand the key strategies and operations of the business and assist the business in identifying compliance risks and develop and implement solutions as part of a comprehensive risk assessment and management process.
- Develop and implement written policies and procedures to ensure compliance with FDA and federal healthcare program requirements, and all other applicable federal and state laws.
- Oversee the design and execution of compliance auditing and monitoring activities.
- Identify compliance training needs and create and deliver compliance education programs.
- Oversee transparency reporting, including compliance with US federal Sunshine Act and state disclosure law reports.
- Stay abreast of regulatory developments and industry trends and best practices to identify opportunities to enhance NHSc Pharma Compliance Program.
- Chair Pharma Compliance Committee meetings
- Prepare and deliver an annual Pharma Compliance Report to leadership
Corporate Compliance Program
Implement, monitor and continuously improve the NHSc U.S. Corporate Compliance program:
- Coordinate a robust compliance program to assess and addresses primary areas of compliance risk through a Corporate Compliance Committee, acting as Corporate Compliance Committee Chairperson.
- Oversee activities necessary to ensure employee adherence to Nestle’s Corporate Code of Conduct and Conflicts of Interest Policies, including reviewing, actioning and/or escalating reported potential conflicts of interest to the Corporate Compliance Committee as appropriate.
- Develop and maintain effective lines of communication with key stakeholders and throughout the company, embodying an open-door culture and overseeing a robust disclosure program including an anonymous hotline.
- Coordinate and implement compliance initiatives and training required by Nestlé Global Legal and Compliance, in collaboration with human resources.
- Support HR in Investigating reported or suspected violations of applicable laws, regulations or compliance policies and advise corrective action where appropriate.
- Prepare and present an annual consolidated NHSc U.S. Corporate, Healthcare and Pharma Compliance Report to the Corporate Compliance Committee, which includes the NHS CEO.
- Lead and guide Compliance team, maintaining a motivated, productive, competent team and overseeing the work of compliance personnel.
- Demonstrate consistent and unwavering commitment to the core values of the company.
EXPERIENCE AND EDUCATION REQUIREMENTS
- BA/BS degree required; Advanced Degree (i.e., JD, MBA, Masters of Healthcare Administration) preferred
- Healthcare Compliance Certification is required.
- Ten (10) years of experience is required in a legal, regulatory, or compliance position(s) in healthcare products or pharmaceutical industry is required.
- Experience in developing and implementing policies and SOPs that ensure compliance with the False Claims Act and Anti-kickback Statute is strongly desired.
- Experience developing and implementing an effective compliance program in the pharmaceutical/biotechnology industry is strongly desired
- Experience with transparency reporting, federal and state, is strongly desired.
- Experience in creation and delivery of healthcare compliance and corporate compliance training is strongly desired.
- Experience with Marketing/Sales literature/promotional review and approval is strongly desired.
- People leadership experience is preferred.

The approximate pay range for this position is $180,000 – $200,000. Please note that the pay range provided is a good faith estimate for the position at the time of posting. Final compensation may vary based on factors including but not limited to knowledge, skills, and abilities as well as geographic location.
